1. General Agreement
By using HumbleServers products and services, you agree and will comply with all of our policies. We reserve the right to cancel, suspend, or terminate any service provided with or without a refund or notice or warning for any reason. We also reserve the right to modify our Terms of Service at any time without client notification. It is up to the client to periodically check for modifications.
Definitions: “Client”, “Users”, “You” and “Your” refers to you, the person accessing this website. “The Company”, “Ourselves”, “We” and “Us”, refers to HumbleServers.
2. Payments, Refunds, and Cancellations
- Payment Due: It is the buyer’s responsibility to pay before the payment is due. Failure to do so will result in service suspension.
- Termination: Services are terminated after 7 days of overdue payment. If you wish to retrieve data after termination, it will not be possible.
- Late Fees: If the buyer pays late, late fees may be added to the invoice.
- Refund Policy: We only provide refunds within 24 hours of the initial purchase.
- Stripe payments may incur fees when refunding.
- Exceptions: Dedicated servers, reseller plans, and promotional offers are not eligible for refunds.
- We reserve the right to deny refunds if the Acceptable Use Policy is violated.
- Cancellations: It is the client’s responsibility to cancel recurring subscriptions (e.g., PayPal) upon service termination.
3. Disputes & Chargebacks
Any payment chargeback or dispute will result in the immediate termination of your service. Any legal threats will also result in the immediate termination of your service(s) with us.
4. Support Policy
- Unmanaged Service: All of our support is unmanaged. We provide the essentials needed to get full access to your service and basic knowledge of hosting.
- Limitations: We will assist with hardware or control panel issues, but we do not provide support for cracked plugins, illegal files, or internal software configuration.
5. Service Level Agreement (SLA)
We guarantee a network uptime of 99.9%.
- Compensation: In the unlikely event that the service is inaccessible, the client may open a ticket to be compensated via service downtime duration.
- Exclusions: We are not held responsible for unplanned outages due to third-party software or hardware failures.
6. Backups
- Cycle: Each server is backed up every 12 hours and kept on our off-site server.
- Restoration: If you require a backup restoration:
- Active Subscription: Free of charge.
- No Subscription: There is a $5 fee for services without the backup subscription (if the server has been terminated within the past 14 days and files are still available).
- Liability: HumbleServers is not liable for any loss of backups/files.
7. Acceptable Use Policy (AUP)
- Shared Resources: CPU cores are shared. If you use 100% of the cores for an extended period, we will ask you to reduce usage. Failure to do so may result in termination without refund.
- Virtual Cores: Clients using paid “Virtual Core” addons may use their cores at 100%.
- Web Hosting: Clients using shared website hosting are not allowed to run or publish games on the website node.
8. Forbidden Activity
The following activities are strictly prohibited and will result in immediate suspension/termination:
- Denial of Service (DoS/DDoS) attacks
- Port scanning / Botnets
- TOR exit nodes / Proxies / Open DNS resolvers
- Illegal downloads / Pyramidal schemes
- Virtual currency mining (Crypto mining)
- Crawlers / IP spoofing / Phishing
- Ram Hacks / Stresser Websites
- Adult materials
9. Copyright & DMCA
All files on users’ services are the user’s responsibility. HumbleServers holds no responsibility for what our clients upload. We do not allow any forms of copyright violation.
